Judge suspends prosecution of Phillip Garrido; sanity at issue

A judge in Placerville suspended the criminal prosecution of accused kidnapper Phillip Garrido after his public defender declared she doubted his mental competency to face trial.

The judge ordered a hearing for Oct. 8 on whether to appoint a mental expert to examine the 59-year-old alleged kidnapper of Jaycee Lee Dugard, who was abducted in 1991 at the age of 11.

The judge said he would allow the prosecution of Garrido’s wife, Nancy Garrido to proceed. But he said he had his own doubts about Phillip Garrido’s competency after public defender Susan Gellman said she, too, doubted his competency. The judge suspended the case.

The development could delay the prosecution of Phillip Garrido indefinitely.

His wife still faces a hearing Oct. 1.

    Justice, what justice. If he is insane then he should never ever leave the institution for the criminaly insane until he is carried out in a box.

    Obviously, the man is insane. That doesn’t absolve him of responsibility for his MANY criminal acts over the years. Where is justice for the victims?

    looks like good retirement with health benefits…….that’s why down in the deep South they don’t wait for jurys…they bring the rope fix it at the scene.

    Obviously he has mental problems, or he wouldn’t have committed the crimes he did, that’s a given, but I believe he knew right from wrong, it’s a pretty simple concept easily understood by almost everyone. Still doesn’t mean you want to get caught, and will turn yourself in, but you know what you are doing is wrong, and it’s being done to others, not a crime committed against yourself.

    They knew it was wrong. They did not ask permission to take Jaycee. They stole her and kept her. He raped her. She was abused for years.
    I want a speedy trial and then never want to hear of them again.
    I don’t want to read his or her books or see their movie, I want them to be gone.

    dreamer—–Why put him away and have us pay to support him for the rest of his life? Terminate him and our costs are over unless you personally want to support him. I’m sure the prison system will be happy to send you the bill.

    Yeah, put him away so they can let him out again!! There is something wrong with all this …. We to are insane for letting him back out is the first place.. I with for the death sentance!! Plus a peace of freedom and saftey for Jaycee and her family :)
