Opinion: Proof in TRPA Charter change is possible

Dear Publisher,

I see there are several of your readers who allege the TRPA is “the law” and that we have no choice but to do as we are told. These comments also allege that I am wrong and don’t know the law. However, any eighth-grade student can read the TRPA Charter and determine that the TRPA does not have the authority it currently claims. Take a look at Article VI of the TRPA Charter and you’ll see that its powers are supposed to be “general and regional in application,” leaving the writing and enforcement of specific and local ordinances to local jurisdictions like the city of South Lake Tahoe:

“Whenever possible without diminishing the effectiveness of the regional plan, the ordinances, rules, regulations and policies shall be confined to matters which are general and regional in application, leaving to the jurisdiction of the respective States, counties and cities the enactment of specific and local ordinances, and rules, regulations and policies which conform to the regional plan.” (Emphasis added)

What part of “whenever possible,” or “confined to matters which are general and regional,” or “leaving to the jurisdiction of … cities,” does the TRPA, or my critics, not understand?

The elected officials of South Lake Tahoe have the legal authority to override the TRPA enforcement codes, to ignore its BMP requirements, and to tear up TRPA red tags, so long as the City Council is prepared to uphold the Constitution and protect its residents from such overregulation and illegal abuse.

    I was wrong. I thought Steve was a one issue candidate: marijuana. Apperently he has a second issue. If elected he would like to focus all of his time and as many city resources as possible fighting an unwinable war against the TRPA. He doesn’t want to turn South Lake Tahoe into Amstredam, he wants to turn it into Afghanistan!! WTF!!

    Agreed – this guy has no idea what he’s talking about and furthermore needs to align his priorities with the electorate…getting high and fighting the TRPA is not *high* on my list of priorities….

    Mr. Moore, how does asserting local control turn SLT into Afghanistan? Mr. Kubby seems to want to turn the economy in a positive direction for we, the people, and not keep the status quo of an organization (TRPA) that is stifling our local economy. It is in our interests, as citizens, to assert local control while living within the spirit of why the compact was first created. And maybe it’s time to revisit why we have the compact in the first place.

    The crater, also known as the convention center, is a result of governance as usual. Mr. Kubby seems to find a balance between the environment and the rights of the people. The Convention Crater makes us already look like Afghanistan. After reading http://kubby4citycouncil.com , I know who the right candidate is for making this place a better place to live and to work. Which is scary to the status quo, but what do I know?

    Like I,ve said before, Kubby is not a get along go along type of guy and can tell who is B.S.ing the council. If it matters I,ve been in business here over 30 years and have voted here for 38 years, and it is nice to see someone like Kubby, has a chance to being elected.

    I’ve known Steve Kubby for many years and he is the kind of guy who both supports local control and is willing to shake things up. He is also willing to try things and back off if it is not working so he can try something different to find out what works best. That’s a lot better than being an inflexible ideologue. Wow, a thinking person who supports local control running for a Council seat; I hope the voters have enough courage and integrity to elect him.

    After hearing Kubby speak I feel he is down to earth with his ideas about the TRPA. The only nuts I see here are the ones against him. The locals I speak too are all hurting for jobs and do nothing but complain, or even worse, move off the hill. The TRPA has ruined our econonmy and any tree huggers should think of moving to a less populated environment if they don’t want to see SLT move forward in progress. This town will thrive again as it did in the ’50’s and ’60’s but only if the TRPA takes a back seat. I’m not promoting another Tahoe Key’s folks. Just a man who wants to get our town back on a positive track.

    Steve, interpereted and spoken like a true liberterian, which champions limited government ( and in some cases no government ), therefore self government and because people with the most resources, ie capital, are not greedy, it all works out, including the sustaining of our ecosystems and enviroment. No, we do not want another Tahoe Keys, however, we will receive something similar if we go back to the 50’s and 60’s or even the logging of the comstock era. Steve, what part of ” without diminishing the effectiveness of the regional plan, the ordinances, rules, regulations, and policies ” do you not understand? Just look at areas with little to no oversight or sustainability ( start with 3rd world country’s ) and ask yourself, do I or we want Tahoe, the jewel in the sky, to look remotely like that? Greed has no shame, be careful what you advocate.
