The South Lake Tahoe man accused of murdering his roommate has been released from jail.

A spokeswoman for the El Dorado County District Attorney’s Office told Lake Tahoe News her office is waiting for the police department to finalize reports before they would contemplate issuing a criminal complaint.

Because of this, Brad Macewan is currently a free man. He had been kept in jail as long as legally possibly on a probation issue, according to a police spokesman.

Way to go, South Lake Tahoe! If this guy goes and murders someone else, who is going to pay? ($20 million got paid to Jaycee Dugard – and that wasn’t murder)

Not the same thing set of circumstances Elizabeth. In this case there is not enough evidence to make a charge stick. The state settled with Jaycee Dugard because of dozens of documented mistakes made by the parole board while they were supposed to have oversight of Garrido.

The problem here is that the police arrested a man without sufficient evidence to bring the case to court? Am I missing something? It sounds like an overreaction by an individual police officer. Or, focus on the wrong indiviual through assumption, like El Dorado County did in the Dugard case with Mr. Probyn (sic).

actually, to make an arrest, you only need probable cause, to get a conviction, you need beyond a reasonable doubt. It is actually not un-common that suspects get arrested before the full investigation is complete.
