S. Tahoe optimistic League’s case will be dismissed
By Kathryn Reed
It took about 45 minutes for both sides in the League to Save Lake Tahoe-South Lake Tahoe General Plan case to try to convince U.S. District Court Judge Garland Burrell of their opinions.
The city is asking the court to dismiss the case.
“The motion to dismiss is on the basis they are arguing that we need to get the TRPA’s consent or approval prior to approving the General Plan,” City Attorney Patrick Enright told Lake Tahoe News.
The city’s contention all along is that segments that are inconsistent with the current Regional Plan used by the Tahoe Regional Planning Agency would not be valid until changes are made to the Regional Plan. It’s anticipated when the TRPA plan is adopted in a year the city’s document would be fully compliant at that time.
South Lake Tahoe’s two city attorneys and Councilman Tom Davis attended the hearing this week in Sacramento. Attorney Michael Lozeau was the only person at the hearing on behalf of the League.
Enright said the line of questioning the judge asked encouraged him. He expects a ruling within 30 days.
Is there anyway the city can sue the League for filing a frivolous lawsuit? Evidently they can’t think too far ahead to figure out what the city is trying to do. They’re no Bobby Fischer for sure.
Please don’t forget dear taxpayer that SLT spent about 800,000 bucks for this waste of time and effort document. Our land use is basically controlled by TRPA, so why did SLT throw about 800,000 smackaroos to outside consultants?
For the same reason STPUD is spending 25,000,000 small ones on water meters.
That is right. The STATE said so. No benefits, no public improvements, no nothing for your money. And SLT even gets sued for it efforts. IIHWAD
This is a case of “busy work” by The League, a way to bill hours, and justify the donated funds they take in.
Total waste of time and good intentioned donations. Nothing was going to happen with South Lake Tahoe’s General Plan. It needed to be done, was behind schedule, and hopefully would spur TRPA to get there late plan done.
If people really knew what the league was truly about, you would see less keep Tahoe blue stickers, what does this litigation have to do with clarity? Nothin
How does this “keep Tahoe blue”? The league to sue LT is getting further off course and obstructive.
