Court upholds ban on high-capacity gun magazines

Signaling a major win for gun control advocates, a California court ruled Wednesday that a city’s ban on high-capacity gun magazines is both constitutional and in the best interest of a city trying to curb gun violence.

The 9th U.S. Circuit Court of Appeals upheld a ruling that the Sunnyvale, California, city ordinance, which prohibits the possession of ammunition magazines capable of holding more than 10 rounds, does not violate the Second Amendment. The lawsuit was brought forward by the National Rifle Association and other gun groups.

“The Second Amendment right is ‘not a right to keep and carry any weapon whatsoever in any manner whatsoever and for whatever purpose,'” Judge Michael Daly Hawkins wrote for the unanimous three-judge panel.

    Court or no court, it’s still a stupid law. If you’re in a situation where you actually need a gun, there’s no such thing as having too much ammunition. It’s only bad if you have too little.

    I totally agree with “copper”. Idiotic laws that do nothing to punish criminals & the State condoning of criminal behavior (sanctuary for illegal aliens) are the big reasons I left CA years ago. You couldn’t pay me enough to move back to CA & surrender my Constitutional rights. Guns & magazines aren’t the problem. It’s the incessant push by liberal/progressives to eradicate all Judeo Christian values, total moral breakdown of society & resulting glorification of violence in various media that are the root.

    With all due respect, Another X, I appreciate your limited agreement, but please separate me from the rest of your post. Judeo Christianity was pretty much buried by Saul of Tarsus and little has been heard from it since.

    Sunnyvale is not a really major city in the state.

    This is a statement of sentiment that will not likely have immediate far reaching affects.

    It is quite similar to the declaration by Berkeley and a few other US cities that they are “nuclear free zones”.

    Between the media, movies, the military and police forces, the phrase “spray and pray” seems to be what people pressing for high count magazines are looking for.
    Seems to me, one or two well placed rounds are far better, and safer, than blasting 20 round bursts. But only if you know how to shoot.

    Elliot Rodgers passed a California background check before murdering 3 with edged weapons, and murdering 3 with 10 rd. magazines. He also ran a man down with his car. Gun control is a failure. The magazine capacity limit is laughable.
